Judge Reverses ATF Restrictions on 80% Lowers and Frames

August 8, 2023

Today, the victory against the ATF's "frame or receiver" rule has been put on hold by the Supreme Court. This means the rule will remain in effect while the government appeals the district court’s judgment that vacated it. The case will now continue at the Fifth Circuit where oral arguments are scheduled for September 7th.

If the Fifth Circuit upholds the vacatur of the Rule, the Stay remains in place until the Supreme Court either accepts and decides the case or rejects the case.

Judge Alito has extended the stay until 5pm EDT on 8/8.

Regarding the lawsuit contesting the ATF's "frame or receiver" rule, significant developments have occurred at the Supreme Court:

  1. The Supreme Court has asked Firearms Policy Coalition to submit a response by 5 pm Eastern on 8/2.
  2. The district court victory has been temporarily halted (stayed) until 5 pm Eastern on 8/4 to allow sufficient time for the Court to rule on the motion.

They are urging the Supreme Court of the United States to overturn the Texas federal judge’s nationwide pause on ghost gun regulations. The administration’s argument centers around the need for an immediate halt to the ruling, citing concerns about public safety. 

The recent court rulings offer some hope, but the battle is far from over. The government’s application to the Supreme Court calls for your help in defending the Second Amendment and protecting our rights.



UPDATE July 25, 2023

Another huge victory!


It was decided by the 5th circuit appeals court yesterday evening (July 24, 2022) that the frame / receiver portion of the rule stay vacated. However, the ATF will be able to challenge other parts of the rule that weren’t challenged in the law suits against the ATF in the appeals court (5th circuit). It sounds like this will be expedited in the appeals court. Hopefully the entire rule will be dead soon. This is a huge victory for us as we are able to operate like we had before the rule went into effect.

UPDATE July 20, 2023

The District Court denied the governments request to block the order vacating the Rule during the appeal process, but it did grant the request to block the Rule for 7 days while the government asks the 5th Circuit to block the Rule pending appeal. The government has now filed that Motion for Stay Pending Appeal with the 5th Circuit.
